2. Terms and Conditions of Sale

Article 1 — Purpose
These terms and conditions of sale (the “T&Cs”) govern sales of products concluded on the Site between SELLER NAME (the “Seller”) and any non-trading individual making a purchase (the “Customer”). Any order implies unreserved acceptance of the T&Cs in force on the day of the order. The Seller reserves the right to amend them at any time; the applicable T&Cs are those accepted when the order is confirmed.
Article 2 — Seller identity
The Seller's identification details are given in the Site's Legal Notice. Customer service: contact@lysse.fr, reply within 24 to 48 business hours.
Article 3 — Products
The products offered are those shown on the Site on the day it is consulted, while stocks last. Their essential characteristics (material, dimensions, care) are stated on each product page.
Photographs and illustrations are as accurate as possible but are not contractual: slight variations in shade may appear depending on your screen settings. As silk is a natural material, very slight variations in appearance from one item to another are normal and do not constitute a defect.
Article 4 — Prices
Prices are shown in euros, all taxes included, excluding shipping costs. The statement “VAT not applicable, article 293 B of the French General Tax Code” applies: no VAT is charged. (If subject to VAT: “Prices include all taxes, French VAT at the applicable rate.”)
Shipping costs are shown before the order is finally confirmed and repeated in the order summary. The Seller reserves the right to change its prices at any time; products are invoiced at the price in force when the order is confirmed.
Article 5 — Orders
The Customer selects the products, checks the details of the order and its total price, corrects any errors, then confirms the order and proceeds to payment. This confirmation constitutes acceptance of these T&Cs and forms the contract of sale (double click, articles 1127-1 et seq. of the French Civil Code).
A confirmation email summarising the order is sent without delay. The Seller keeps a record of the order; the Customer may obtain a copy on request.
The Seller reserves the right to refuse or cancel any order for a legitimate reason (ongoing payment dispute, abnormal or clearly fraudulent order).
Article 6 — Payment
Payment is made online at the time of ordering, by bank card or by the payment methods offered at checkout (Apple Pay, Google Pay, Shop Pay, PayPal — to be adjusted).
Transactions are secured by the payment provider and pass through an encrypted environment. The Seller never has access to its customers' card numbers, which it neither collects nor stores.
The order is only processed once payment has actually been received. If the bank refuses authorisation, the order is automatically cancelled.
Article 7 — Availability
Offers are valid as long as they are visible on the Site, while stocks last. If a product is unavailable after the order, the Customer is informed as soon as possible and refunded in full within 14 days at the latest.
Article 8 — Delivery
Terms, zones and delivery times are detailed in the Shipping Policy, which forms an integral part of these T&Cs.
In accordance with article L.216-1 of the French Consumer Code, the Seller undertakes to deliver no later than 30 days after the contract is concluded. Failing this, the Customer may terminate the contract after asking the Seller to deliver within a reasonable additional period; the Customer is then refunded all sums paid, no later than 14 days after termination.
Risk passes when the product is physically handed over to the Customer. On receipt, we recommend checking the condition of the parcel and reporting any problem to the carrier and to customer service.
Article 9 — Right of withdrawal
In accordance with article L.221-18 of the French Consumer Code, the Customer has 14 days from receipt of the last product in the order to exercise the right of withdrawal, without having to give reasons or pay any penalty.
To exercise it, simply send an unambiguous statement to contact@lysse.fr, or use the model form annexed to these terms.
Products must be returned within 14 days of notifying the decision to withdraw. Return costs are paid by the Customer / are covered by LYSSE — choose one and state it clearly.
The refund, including standard outbound shipping costs, is made no later than 14 days after the products are recovered or proof of their dispatch is received, using the same payment method as the one used for the order.
The Customer may be held liable for any loss in value of the products resulting from handling other than what is necessary to establish their nature, characteristics and proper functioning.
Article 10 — “30-night trial” commercial guarantee
In addition to the statutory right of withdrawal, the Seller offers a commercial guarantee: for 30 nights from receipt, the Customer may try the product and, if it does not suit them, request a refund, even if the product has been used and washed.
Conditions: one request per customer and per product; the product must be returned clean and complete; the request must be made by email before the end of the 30th day after receipt. Return costs are paid by the Customer / free.
This commercial guarantee is in addition to, and does not replace, the statutory guarantees.
Article 11 — Statutory guarantees
All products benefit from the statutory guarantee of conformity (articles L.217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (articles 1641 to 1649 of the French Civil Code). To use them, the Customer contacts customer service at contact@lysse.fr. The cost of returning a non-conforming product is paid by the Seller.
Statutory guarantee of conformity
The consumer has two years from delivery of the goods to invoke the statutory guarantee of conformity if a lack of conformity appears. During this period, the consumer only needs to establish the existence of the lack of conformity, not the date on which it appeared.
The statutory guarantee of conformity obliges the professional, where applicable, to provide all updates necessary to keep the goods in conformity.
The statutory guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of the request, free of charge and without major inconvenience. If the goods are repaired under the statutory guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee. If the consumer requests repair but the seller imposes replacement, the statutory guarantee of conformity is renewed for two years from the date of replacement.
The consumer may obtain a price reduction while keeping the goods, or terminate the contract and receive a full refund on return of the goods, if repair or replacement is impossible, is not carried out within one month, or causes the consumer major inconvenience. Termination of the contract is not permitted if the lack of conformity is minor.
These rights result from articles L.217-1 to L.217-32 of the French Consumer Code.
A seller who obstructs in bad faith the application of the statutory guarantee of conformity is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of average annual turnover (article L.241-5 of the French Consumer Code).
The consumer also benefits from the statutory guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect, but no more than twenty years from delivery of the goods. This guarantee entitles the consumer to a price reduction if the goods are kept, or a full refund on return of the goods.
Article 12 — Complaints
Any complaint must be sent to contact@lysse.fr quoting the order number. The Seller undertakes to reply within 48 business hours and to seek an amicable solution.
Article 13 — Personal data
Data collected is processed in accordance with the Site's Privacy Policy and Regulation (EU) 2016/679 (GDPR).
Article 14 — Force majeure
Neither party can be held liable for failure to perform its obligations in the event of force majeure within the meaning of article 1218 of the French Civil Code. If the impediment lasts longer than 60 days, the contract may be terminated and the Customer refunded.
Article 15 — Governing law and disputes
These T&Cs are governed by French law. In the event of a dispute, the Customer should first contact customer service. Failing agreement, the Customer may use, free of charge, the consumer mediator named in the Legal Notice. Failing an amicable resolution, the French courts have jurisdiction under ordinary law.
Article 16 — Partial invalidity
If any provision of these terms is declared void or unenforceable, the other provisions remain in full force.
